Questions advocates ask about Service & labour

A government servant challenges dismissal before the Administrative Tribunal or the High Court, and the court does not retry the departmental inquiry: it checks that the inquiry was fair and the penalty proportionate. A workman's remedy lies under industrial dispute law, which the Industrial Relations Code, 2020 replaced from 21 November 2025.

Where is a government employee's service dispute filed?

Disputes of central government employees go to the Central Administrative Tribunal. Employees of a state go to the State Administrative Tribunal where one has been set up, and otherwise to the High Court under Article 226. The Supreme Court has held that a tribunal's decision can be challenged by a writ petition before a Division Bench of the High Court within whose jurisdiction the tribunal falls.

What must a departmental inquiry follow, and how far will a court interfere?

A civil servant cannot be dismissed, removed or reduced in rank without an inquiry in which they are told of the charges and given a reasonable opportunity of being heard. The exceptions are few: conviction on a criminal charge, a case where it is not reasonably practicable to hold an inquiry, and the security of the State, and the second needs a recorded reason. The standard of proof is preponderance of probability, not proof beyond reasonable doubt. A court does not re-appreciate the evidence. It interferes where the finding has no evidence behind it, where natural justice was denied, or where the punishment is so disproportionate that it shocks the conscience of the court.

Constitution of India, Art. 311(2); B.C. Chaturvedi v. Union of India, (1995) 6 SCC 749

Can a court order regularisation of long-serving temporary staff?

The general rule is no. The Constitution Bench in Umadevi held that a person appointed without following the constitutional scheme of public employment cannot claim regularisation as a right, and allowed only a one-time exercise for those who had worked for ten years or more in sanctioned posts without the protection of court orders. Later decisions have looked at when long service against a permanent need can justify relief, so read the recent decisions against your facts before advising.

When is a retrenchment illegal?

Under the Industrial Disputes Act, 1947, a workman who has worked continuously for a year, which means 240 days in the 12 months before retrenchment, cannot be retrenched without one month's written notice or pay in lieu, compensation of fifteen days' average pay for each completed year of service, and notice to the appropriate Government. A retrenchment in breach of this is invalid. The Industrial Relations Code, 2020 came into force on 21 November 2025 and carries the same protection in its own provisions. Which law governs a given termination depends on its date and the transition rules the Government has notified, so check them.

Does an illegal dismissal always mean reinstatement with back wages?

Ordinarily it does. The Supreme Court has said that reinstatement with continuity of service and back wages is the normal consequence of a termination found illegal. The court has a discretion, though. Where reinstatement is not workable, for example because of the passage of time or the closure of the establishment, a lump-sum compensation has been awarded instead, and back wages can be reduced where the employer proves that the workman was gainfully employed in the meantime.
