The Supreme Court dismissed Jyoti Builders' appeal, holding that Section 14 of the Maharashtra Slum Areas (Improvement, Clearance and Redevelopment) Act, 1971 does not oblige acquisition of the subject property since the owner's preferential right under Section 3D(c)(i) to redevelop remains intact, as crystallized in Tarabai Nagar Co-Op.
