Bijoy @ Guddu Das v. State of West Bengal
Calcutta High CourtMANU/WB/0140/2017Bench: J. Nishita Mhatre, J. Arindam Sinha
The Calcutta High Court held that POCSO courts have both the power and the duty to proactively order confidentiality of the victim's identity. The order for confidentiality need not wait for an application — courts must take it up suo motu. On interim compensation, the Court held that the POCSO Act read with the National Legal Services Authority Scheme empowers courts to direct interim compensation to the victim pending final disposal. Interim compensation ensures that the victim can access medical, psychological, and rehabilitation support during the trial period.
