In matrimonial proceedings, the standard of proof is preponderance of probabilities (civil standard), not beyond reasonable doubt (criminal standard). Cruelty does not have to be physical — persistent mental harassment, repeated false accusations, conduct that makes the petitioner's life miserable, constitutes cruelty. Divorce on grounds of cruelty was granted.
