Supreme Court of India(2001) 7 SCC 740Bench: G.B. Pattanaik J, S.S.M. Quadri J, M.B. Shah J, Doraiswamy Raju J, D.P. Mohapatra J (5-judge bench)
The Act must be read to mean that the husband must pay a fair and reasonable provision for the divorced wife's future within the iddat period — i.e., the payment must be sufficient to cover her maintenance for the rest of her life. This reading harmonises the Act with Articles 14, 15, and 21. So read, the Act is constitutionally valid.
