Krishnabhat v. Karnataka
Supreme Court of IndiaUnreported (SC)Bench: Justice Vikram Nath, Justice Sandeep Mehta
Criminal law should not be used as a tool for harassment or vendetta. Allegations must disclose a prima facie case before subjecting individuals to criminal trial. The allegations were general, lacked specificity, and were devoid of substantive evidence. Family Court had already granted divorce finding allegations of dowry demand and harassment to be baseless. Continuation of proceedings would amount to abuse of process.
