Barendra Kumar Ghosh v King Emperor
Privy CouncilAIR 1925 PC 1Bench: Lord Sumner, Lord Buckmaster, Lord Atkinson
Section 34 IPC dealing with acts done in furtherance of common intention creates a form of constructive criminal liability. Even if Barendra Kumar Ghosh did nothing and stood only at the door, he was part of the criminal enterprise with common intention to commit robbery. He shared the criminal intention and was as guilty as the actual assailants.
