Privy Council(1903) 30 IA 114 (PC)Bench: Lord Macnaghten, Lord Davey, Lord Lindley, Sir Ford North, Sir Andrew Scoble
A contract entered into by a minor is void ab initio and not merely voidable. A minor cannot ratify such a contract on attaining majority. The mortgagee was not entitled to restitution of the loan amount since the contract was void from inception.
