Consumer fora cannot travel beyond the pleadings to construct a new case. The NCDRC transgressed its jurisdiction by building a new case of 'antenatal negligence' when the complaint was confined to 'post-delivery negligence'. The complainant was directed to refund Rs. 10 lakhs compensation received.
