Primacy in judicial appointments belongs to the Chief Justice of India, acting in consultation with the two senior-most puisne judges. The executive must accept the Collegium's recommendation unless the ground for rejection is disclosed in writing and the Collegium reiterates its recommendation — in which case the appointment must be made.
