The power of judicial review over legislative and executive action is a basic feature of the Constitution and cannot be ousted. Administrative Tribunals can function as courts of first instance but the jurisdiction of the Supreme Court and High Courts cannot be excluded. Clause 2(d) of Article 323A and clause 3(d) of Article 323B which excluded High Court jurisdiction are unconstitutional.
