The executive (President acting on the advice of the Council of Ministers) has primacy in the appointment of judges. The "consultation" required with the Chief Justice of India under Articles 124 and 217 does not mean "concurrence". Public interest litigation was recognized as a legitimate tool for enforcing constitutional rights of disadvantaged groups.
