Sabarimala Case
Supreme Court of India(2018) 11 SCC 1Bench: Dipak Misra CJ, A.M. Khanwilkar J, D.Y. Chandrachud J, Nariman J (majority 4:1); Indu Malhotra J (dissent)
Exclusion of women from the temple on grounds of physiological factors (menstruation) is unconstitutional. It violates Articles 14, 15, 17, 25, and 26. The exclusion constitutes discrimination on grounds of sex and is untouchability in a broader sense. No religious denomination's "essential religious practice" can override fundamental rights.
