Kedarnath Singh v State of Bihar
Supreme Court of IndiaAIR 1962 SC 955Bench: Sinha CJ, Shah J, Kapur J, Sarkar J, Mudholkar J (5-judge Constitution Bench)
Section 124A IPC (sedition) is constitutionally valid but must be read narrowly. The provision applies only to acts that have the tendency to create disorder, or disturbance of law and order, or incitement to violence. Criticism of government, however strong, does not amount to sedition. The section must be interpreted to be confined to the actual or intended incitement of violence or imminent threat to public order.
