Nanavati v State of Maharashtra
Supreme Court of IndiaAIR 1962 SC 605Bench: Sinha CJ, Imam J, Shah J, Mudholkar J, Kapur J (5-judge Constitution Bench)
The Supreme Court upheld the High Court's conviction. The killing was not done in the heat of passion immediately upon provocation but was premeditated — Nanavati had gone to the ship, obtained a revolver, and returned to confront Ahuja. The exception of grave and sudden provocation under Exception 1 to Section 300 IPC was not available.
