Section 377 IPC, to the extent it criminalises consensual sexual conduct between adults of the same sex in private, is unconstitutional and violates Articles 14, 15, 19 and 21. It remains operative for non-consensual acts and acts involving minors or animals. Suresh Kumar Koushal v. Naz Foundation (2013) was overruled. Sexual orientation is an essential and innate attribute of identity and dignity.
