Advocate Playbook 119 EduLaw Family Law • Matrimonial Litigation • Pre-Filing Strategy How Senior Advocates Prepare a Divorce Case Before Filing the Petition A practical 2026 framework to turn a client’s matrimonial history into a legally sustainable case built around the correct ground, chronology, evidence, finances, children, jurisdiction and relief. India-focused • Updated September 2026 • Hindu Marriage Act worked framework Quick answer Do not begin with drafting. First identify the governing marriage law and exact statutory ground. Then build a master chronology, map every material fact to proof, audit parallel proceedings, quantify financial and child-related issues, verify jurisdiction and test settlement. Only after those sheets agree with each other should the petition be drafted. A divorce petition is strongest when the legal theory is built before the pleading. Clients usually narrate a marriage as a long sequence of emotions, disputes and memories. The advocate must convert that narrative into a smaller set of legally material facts that can be pleaded consistently, proved through admissible material and defended under cross-examination. Scope note: This article uses the Hindu Marriage Act, 1955 as the principal worked example. A real file may instead be governed by the Special Marriage Act, Divorce Act, Parsi Marriage and Divorce Act, personal law or another statutory regime. Confirm the governing law before choosing the ground, forum or relief. Pre-filing divorce case system Case map Ground selection Chronology Evidence ledger Electronic evidence Parallel cases Maintenance Children Jurisdiction Settlement Drafting Red-team review 01 Convert the client story into a matrimonial case map Do not draft while the client is still narrating the history. First extract the data that will control the case. Marriage and residence date and place of marriage governing marriage law registration and marriage proof prior marriages where relevant matrimonial homes and periods of cohabitation exact separation date and any later resumption Current litigation position children and present caregiving maintenance proceedings domestic violence proceedings criminal complaints or FIRs custody / guardianship proceedings restitution, property or other connected cases Divorce Intake Sheet 1 Date / period When did the event happen? Cross-check against messages, travel, addresses and court records. 2 Event What fact actually occurred? Remove adjectives and conclusions. 3 Legal relevance Which statutory ingredient can this fact prove? If it proves nothing material, reconsider pleading it. 4 Evidence What independent material supports it? Document, electronic record, witness or admission. 5 Opponent’s answer How is this likely to be disputed? Prepare for the defence before filing. Practical rule Create the master chronology before selecting the ground of divorce. 02 Choose the ground from the facts, not the other way around Under Section 13 HMA, a contested divorce must rest on a recognised statutory ground. The petition should plead the ingredients of the selected ground, not every unhappy event in the marriage. Route Pre-filing question Key caution Cruelty — s.13(1)(ia) Which specific acts, periods or patterns are relied upon and what effect did they have? Avoid omnibus allegations unsupported by dates or context. Desertion — s.13(1)(ib) Can separation and the legal intention element be established for the statutory period? Separate addresses alone do not automatically establish desertion. Mutual consent — s.13B Are both parties willing to dissolve the marriage and are all settlement terms workable? Consent must remain real; unresolved money, child or case-withdrawal issues can derail the process. Other s.13 grounds Do the pleaded facts actually satisfy the current statutory text? Verify the exact provision and current case law before drafting. Desertion: Section 13(1)(ib) requires a continuous period of not less than two years immediately preceding presentation of the petition. Build the date calculation before pleading the ground. For every proposed petition paragraph, ask: “Which ingredient of my chosen legal ground does this fact help establish?” 03 Build a chronology designed to survive cross-examination A useful matrimonial chronology is not a memory list. It is a reconciliation exercise across independent records. STEP 1 Marriage STEP 2 Cohabitation STEP 3 Material incidents STEP 4 Separation / reconciliation STEP 5 Current proceedings Cross-check each important date against messages and emails bank or payment records travel records medical records where relevant police complaints and legal notices school or child-related records rent agreements and address proof earlier pleadings, affidavits and orders Pre-filing objective Find the harmful document yourself before the respondent finds it for you. 04 Build an evidence ledger before pleading serious allegations An allegation should enter the petition only after counsel knows what will prove it, what will attack it and whether it needs fuller particulars. Proposed fact Best proof Likely weakness Pre-filing action Party left matrimonial home Messages, address records, travel or rent documents Reason for leaving disputed Collect communications showing context Repeated abusive communication Complete chat / email record Selective screenshots lack context Preserve full thread and source Medical incident Hospital / treatment record Causation may be disputed Collect complete contemporaneous file Financial neglect Bank statements, transfers, expense record Cash support may be alleged Reconcile household finances Failed reconciliation Mediation, notices, messages Later cohabitation may contradict Check all subsequent conduct Evidence-led pleading Do not plead first and ask how to prove it later. 05 Preserve digital evidence before screenshots become the case For proceedings governed by the post-1 July 2024 evidence regime, electronic records must be approached under the Bharatiya Sakshya Adhiniyam, 2023. Sections 61 to 63 deal with electronic and digital records, including the statutory framework for admissibility of electronic records. Pre-filing electronic evidence checklist preserve the original device or source where practicable retain complete conversations, not only favourable extracts preserve dates, account identifiers and available metadata record how and from where the material was obtained avoid editing, cropping or re-saving the only available copy plan the Section 63 certificate / proof route where required 2026 evidence point: Do not cite the repealed Indian Evidence Act as the current general evidence statute for new proceedings. The Bharatiya Sakshya Adhiniyam, 2023 has been in force since 1 July 2024, subject to applicable transition rules. 06 Audit every parallel proceeding for contradictions and admissions A divorce petition must coexist with whatever the parties have already said elsewhere. Build one cross-proceeding map before filing. Proceeding What to extract Why it matters Maintenance income assertions, dependence, separation narrative financial credibility and overlapping relief Domestic violence incidents, residence, protection and monetary claims may support or contradict matrimonial chronology Criminal case / complaint dates, allegations, accused-specific role consistency of serious factual allegations Custody / guardianship caregiving history, residence, safety allegations child-welfare narrative must remain consistent Restitution withdrawal from society, willingness to cohabit may interact with desertion / cruelty theory Property litigation residence, possession, financial assertions can affect separation and financial case theory For maintenance litigation, Rajnesh v. Neha remains important for disclosure affidavits, overlapping maintenance jurisdictions and avoiding double recovery. For new criminal-procedure maintenance applications, also check Section 144 BNSS; older CrPC Section 125 proceedings may require a savings / transition analysis. One client. One chronology. Every forum should be checked against it before the divorce petition is signed. 07 Audit money before the first maintenance hearing Sections 24 and 25 HMA can bring interim maintenance, litigation expenses and permanent alimony into the case. Financial preparation should begin before filing, not after service. Income and assets salary slips and employment terms ITRs and tax computations bank statements business financials where self-employed property, investments and shareholdings loans and recurring liabilities Monthly needs housing and utilities food and routine living costs medical expenditure travel and transport child education and healthcare existing maintenance obligations Practical rule File figures, not adjectives. “Financial hardship” is less useful than a reconciled monthly expense sheet supported by documents. 08 Build a parenting file, not a custody speech Section 26 HMA empowers the court to make orders regarding custody, maintenance and education of minor children and to consider the wishes of the child wherever possible. Pre-filing strategy should therefore document the child’s real routine. Map the present arrangement where the child lives who handles day-to-day care school location and timings medical needs holiday and access arrangements travel between parents communication pattern with each parent genuine safety concerns, if any Primary proposal The custody / access structure the client ultimately seeks, supported by caregiving history and logistics. Interim proposal A workable arrangement that can operate immediately while the litigation continues. Better family-law advocacy A practical parenting plan is usually more useful than a page of labels about the other parent. 09 Check whether the petition can be filed before arguing its merits Threshold issue 2026 pre-filing check One-year bar — s.14 HMA Ordinarily no divorce petition within one year of marriage. Early presentation requires court leave on the statutory exceptional-hardship / exceptional-depravity basis. Territorial jurisdiction — s.19 Verify the precise statutory jurisdictional fact and documentary address support. Petition contents — s.20 Material facts supporting the relief must be stated distinctly and the petition properly verified. Conditions for relief — s.23 Audit own wrong, condonation where relevant, collusion and unnecessary or improper delay. Family Court forum Where a Family Court is established and the Family Courts Act applies, confirm the correct forum and local filing practice. Jurisdiction drafting tip: Never copy a standard jurisdiction paragraph before verifying the marriage place, respondent’s residence, last shared residence and any special statutory basis actually relied upon. 10 Test settlement before locking the file into contested litigation Section 13B HMA permits mutual-consent divorce where the statutory conditions are satisfied. The second-motion six-month period is directory rather than invariably mandatory and may be waived in an appropriate case under Amardeep Singh v. Harveen Kaur . But settlement needs a complete matrix Issue Settlement term to define Divorce first motion, waiver strategy where appropriate, second motion Alimony / maintenance amount, mode, instalments, trigger dates and tax / payment logistics where relevant Children custody, access, holidays, school, medical expenses and communication Stridhan / articles itemised list, handover date, acknowledgement Property / loans transfer, possession, liabilities and documentation Pending cases withdrawal, disposal, quashing or consent-order sequence Default what happens if a payment or litigation step does not occur Do not confuse two concepts: “irretrievable breakdown” is not a general standalone Section 13 ground available to every Family Court merely because the marriage appears dead. The Supreme Court’s Article 142 jurisdiction is a separate constitutional power. 11 Draft dates, incidents and prayers — not emotional conclusions Once the case map is stable, the petition should read like a legal pleading rather than a diary. Petition Drafting Skeleton 1 Parties and marriage Identity, status, date, place and governing law. Tie each foundational fact to an annexure where appropriate. 2 Cohabitation and children Shared residences, separation history and child particulars. Keep dates consistent with other proceedings. 3 Material incidents Date / period, place, conduct and consequence. Avoid repeating the same allegation in different adjectives. 4 Ground Link material facts to the statutory ingredients. The pleading should allow the court to see why the ground is invoked. 5 Jurisdiction and relief State the jurisdictional basis and exact interim / final prayers. The prayer must match the case actually pleaded. Section 20 HMA requires the petition to state distinctly the facts on which the claim to relief is founded and to be verified. Section 21 makes the CPC applicable to HMA proceedings subject to the Act and applicable rules. 12 Red-team the petition as opposing counsel before filing Attack point Pre-filing question Ground Have all statutory ingredients actually been pleaded? Dates Do notices, chats, complaints and court records support the chronology? Own conduct Is there a Section 23 “own wrong” issue? Condonation Did later conduct or resumed cohabitation affect an earlier allegation? Delay Is there a delay that requires an explanation? Documents Does any annexure contradict the petition? Proof Can the most serious allegation actually be proved? Money Are income, expenses and liabilities internally consistent? Children Is the proposed arrangement workable in real life? Prayer Does each prayer have a legal and factual foundation? Final pre-filing test The advocate should be able to explain the ground, the 5–7 core facts supporting it, the proof behind each fact, the weakest part of the case, the respondent’s likely answer, the immediate financial / child issues and why this is the correct court — on one sheet. Do not file when the client has finished telling the story. File when the story has been converted into a legally sustainable case. Frequently Asked Questions Can a divorce petition under the Hindu Marriage Act be filed within one year of marriage? Ordinarily no. Section 14 creates a one-year bar, subject to the court’s power to permit earlier presentation on the specific statutory grounds of exceptional hardship to the petitioner or exceptional depravity of the respondent. Is living separately enough to prove desertion? No. Physical separation is only part of the inquiry. Desertion has legal ingredients that must be pleaded and proved, and Section 13(1)(ib) also requires the statutory two-year continuous period immediately preceding presentation of the petition. Can WhatsApp chats be used in a divorce case? Electronic communications may be relevant, but preserve the full record and source and prepare proof under the Bharatiya Sakshya Adhiniyam, 2023. Selective screenshots can create context and authenticity problems. Should all prior matrimonial and criminal proceedings be disclosed to the divorce lawyer? Yes. Earlier complaints, affidavits, maintenance proceedings, custody cases, domestic violence proceedings, restitution cases and settlements may contain admissions or factual positions that materially affect the divorce strategy. What financial documents should be collected before filing? Typically salary and employment records, tax returns, bank statements, business records where relevant, asset and investment details, loan statements, recurring expenses, child-related expenses and existing maintenance orders should be organised before interim financial applications arise. Is the six-month waiting period in mutual consent divorce always mandatory? No. In Amardeep Singh v. Harveen Kaur, the Supreme Court held that the Section 13B(2) period is directory and may be waived in an appropriate case when the relevant conditions are satisfied.
