EduLaw Marketplace Subscription Playbooks Advocate Playbook 149 · Family Law How Senior Advocates Cross-Examine a Spouse in Maintenance Proceedings A courtroom-ready guide to financial affidavits, hidden income, disputed expenses, precise questions and admissions that actually matter. EduLaw Editorial · Updated 29 October 2026 · Indian litigation practice A spouse declares “no income,” but a bank statement shows recurring receipts. Another claims an EMI of ₹42,000, yet the loan appears to be serviced by a company. A third claims ₹30,000 rent although the filed lease mentions ₹18,000. None of these facts proves dishonesty by itself. Each is a precise question that must be tested against evidence. Quick answer: how should an advocate cross-examine in a maintenance case? Identify the governing legal issue; fix the witness's statement from the affidavit; identify the exact document and date; put one clear question per fact; obtain the witness's explanation; and connect the resulting answer to income, reasonable needs, genuine liabilities or past orders. Cross-examination is not automatic at every interim maintenance hearing. It depends on the procedural stage and the court's directions. Important: All names, financial illustrations and witness exchanges below are fictional teaching examples. They are not real court orders or transcripts. Adapt the questions to the actual pleadings, records, lawful production orders and applicable procedure. 1. Know the maintenance provision before you ask a question Indian maintenance litigation is not governed by one identical test. Your examination must follow the particular statute and the issue the court has to decide. Statute What must be investigated Section 144 BNSS (counterpart of former Section 125 CrPC) Statutory eligibility, sufficient means, neglect/refusal and relevant needs. Section 145 BNSS deals with procedure. Section 24 Hindu Marriage Act Whether either spouse lacks independent income sufficient for support and necessary litigation expenses, considering the parties' incomes. Section 25 Hindu Marriage Act Permanent alimony, including relevant income, property and other statutory circumstances. Sections 20 and 23 DV Act Monetary relief connected to domestic violence and interim relief where statutory grounds exist. The central authority is Rajnesh v. Neha , (2021) 2 SCC 324, judgment dated 4 November 2020. It addresses financial disclosure affidavits, relevant quantum considerations and adjustment of overlapping maintenance awards. The Court permitted requests for interrogatories and relevant document production, with judicial permission, where declarations are disputed; read its specific qualifications and exceptions, including those concerning some economically vulnerable parties. Is cross-examination compulsory on an interim maintenance application? No. Interim maintenance may be determined on pleadings and affidavits. Where oral evidence or cross-examination is permitted or directed, use the method below. Where documents are needed first, ask for targeted production and explain why the material disputed fact cannot fairly be assessed without them. 2. Prepare a contradiction ledger before the hearing Do not carry 200 pages and hope to discover a contradiction in open court. Make a one-page ledger: issue → affidavit paragraph → document/date → question → answer → legal relevance. Mark whether a document is admitted, disputed, merely annexed or proved. Affidavit states Record worth examining Proposition to test No employment income Form 16, salary credit, appointment and exit records Current income and character of credits ₹30,000 monthly rent Lease, revisions, payment entries Actual rent and separately billed charges ₹42,000 home loan EMI Sanction letter, bank debits, company books Who owes and who actually pays? No other income Rental receipts, dividends, deposits, business records Actual net benefit or receipts No previous maintenance Earlier application, orders, payment chronology Existing award and overlap Practical rule: An unexplained bank credit is not automatically salary. A lease of an earlier year does not automatically disprove a later rent increase. A company balance sheet is not proof that every rupee belongs personally to a director. 3. How to question a spouse who claims zero income Illustration A — recurring monthly credits The witness's affidavit says there is no present employment income. A disclosed statement shows ₹45,000 arriving from ABC Pvt. Ltd. each month for three months. Q1 You previously worked with ABC Pvt. Ltd., correct? Q2 Your affidavit says you currently have no employment income? Q3 This account ending 4821 belongs to you? Q4 It received ₹45,000 from ABC Pvt. Ltd. on 5 January? Q5 Comparable credits arrived in February and March? Q6 What do these credits represent: salary, consultancy fees, reimbursement, loan proceeds or something else? Q7 Where are these receipts disclosed or explained in your affidavit? Why it works: The witness confirms the declaration, identity of account, individual credits and their possible explanation. If the witness says “It was a loan,” ask for the loan agreement, repayment terms and payment history. If it was a reimbursement, examine the expenses reimbursed. Accept a credible explanation when the documents support it. 4. Cross-examining the spouse who owns a business Business cases require three distinct inquiries: business receipts , net commercial earnings and the spouse's personally available financial resources . Turnover is not personal take-home pay; conversely, a small declared salary may omit dividends, drawings and business-funded personal benefits. Record What it may help establish What it does not prove by itself Gross sales / turnover Scale of business operations Personal income or net profit Net profit, drawings Potential distributable earnings or withdrawals Cash personally available without tax and other adjustments Director salary, dividends Identifiable payment to individual Every possible personal benefit Vehicle, travel or rent paid by business Possible personal perquisites or financial support That all spending was for private purposes Seven useful questions for a business-owning spouse Are you a proprietor, partner, director or shareholder of XYZ Enterprises? What is your ownership percentage and what income did you personally receive in the relevant year? Who maintains the business's financial statements? Does the business pay any part of your personal accommodation, vehicle, travel or other expenses? Have you disclosed any such personal benefits in the assets-and-liabilities affidavit? Is the personal EMI you have claimed paid from your account or a business account? Which financial statements, ITRs and bank entries support the explanation you have given? What to submit: A reconciled calculation of actual resources, including documented benefits and genuine tax, business and family obligations. Avoid equating a company's gross assets with the shareholder's unencumbered personal wealth. 5. The ₹30,000 rent claim versus the ₹18,000 lease Illustration B — disputed rental expense The financial affidavit lists monthly rent of ₹30,000. The available lease describes ₹18,000 basic rent, but is dated in an earlier period and mentions separate charges. Q1 Your affidavit claims ₹30,000 per month towards rent? Q2 The lease dated 1 April 2023 records ₹18,000 as the basic rent? Q3 Was the rent revised after that date? Q4 Is there a later agreement, message, receipt or landlord confirmation? Q5 Are maintenance, parking, utilities or other charges included in the ₹30,000 figure? Q6 Which amounts were actually paid, and in which months? Only then argue the discrepancy. A later increase may be genuine. Separately charged housing costs may also be genuine. Cross-examination should establish the correct figure, not manufacture a lower figure by excluding relevant expenses. Separate three expense buckets Regular: rent, utilities, recurring care, ordinary household support. Periodic: quarterly fees, annual insurance, irregular but predictable expenses. Exceptional: one-off hospitalization, admission fee, genuine arrears. Calculate a monthly equivalent where that assists comparison, but preserve the actual timing. The absence of every grocery receipt is not proof that groceries were never purchased. 6. Education is not employment: earning capacity versus real earnings In Shailja v. Khobbanna , (2018) 12 SCC 199, order dated 18 January 2017, the Supreme Court distinguished the ability to earn from actually earning . It rejected reducing maintenance merely because the wife was capable of earning. The statute, real income, sufficiency and individual circumstances remain relevant. Ask: When did the spouse last work? What was the last drawn remuneration? When and why did employment cease? Is there present freelance work? What actual earnings have accrued since separation? Is childcare, illness, disability or an unavoidable care obligation affecting work? Has the current financial position materially changed? Bad question: “You are a graduate; why don't you work?” Better question: “Your disclosed consultancy invoices show payments in April, June and July. What services generated those amounts, how much net income was received and where is it disclosed?” 7. Children's expenditure and other dependants Separately calculate spousal needs, the child's needs and any other genuine dependant obligations. A fee receipt for ₹1,20,000 does not tell the court whether that amount is annual, quarterly or monthly. Ask whether tuition, transport, medical treatment and activities have been counted twice or paid directly by one parent. Expense Check Follow-up School fees Fee schedule, receipt, period Are the payments annual, term-wise or monthly? Medical treatment Medical record, bills, reimbursements Recurring or one-off? Who actually paid? School transport Bill, payment, fee breakup Already included in another total? Dependent parents Dependency, medical and payment records What is their financial need and who bears it? Do not argue that a child automatically loses a claim because one parent pays a school directly, or that a relative's voluntary gift automatically relieves a legally liable spouse. Identify the precise relief and amounts already met. 8. Investments, assets and lifestyle: test relevance, not appearances Use ownership → availability → income or benefit → disclosure → current value . A property may be owner-occupied rather than rented. Mutual funds may represent accumulated savings rather than recurring income. A business-owned vehicle is not automatically a personal asset. An expensive-looking photo is weak evidence without reliable origin and context. Good sequence: “Do you own a share in this property? Is it tenanted? What rent was received in the relevant period? Who received it? Is it disclosed? Is the property subject to a charge or co-ownership?” 9. Challenging loans and EMIs the right way An EMI must be connected to a borrower, purpose, repayment date, payment account and actual financial burden . A loan may be genuine, but its timing and purpose may still matter. Neither reject all debt nor deduct it automatically rupee-for-rupee from maintenance capacity. Q1 Is this the ₹42,000 home-loan installment declared in your affidavit? Q2 Are you the borrower, co-borrower or guarantor? Q3 When was the loan sanctioned and for what purpose? Q4 Which bank account has paid the last six installments? Q5 Is any installment paid or reimbursed by your company or another person? Q6 Was the loan taken before or after the relevant matrimonial dispute? Do not allege a debt was created to defeat maintenance without a sufficient evidential basis. An EMI's effect on capacity is a question of context, not a mechanical formula. 10. Multiple cases: ensure every earlier order is on record Under Rajnesh v. Neha , earlier maintenance proceedings and orders must be disclosed in subsequent proceedings, and courts consider adjustment or set-off for overlapping awards. A later case is not automatically barred ; child-support, spousal support, arrears and awards for different periods may require distinct treatment. Which earlier maintenance or DV Act proceedings were filed between the parties? Which orders have been passed, on what dates and under what provisions? Who benefits under each order—the spouse, child or another person? Which amounts have actually been paid, deposited or recovered? Where have the prior orders and payment details been disclosed in this case? Prepare a month-wise payment chart and obtain reliable copies of the earlier orders. If variation of an earlier order is sought, determine the proper proceeding to seek it; do not simply ask a different court to disregard it. 11. How to confront the witness with a written contradiction The most efficient method is fix → identify → put discrepancy → obtain explanation → preserve answer . Fix “Paragraph 12 says you had no rental income in 2025, correct?” Identify “This is the lease relating to the property you disclosed?” Confront “It provides for monthly rent of ₹22,000 from January 2025?” Explain “Was that rent actually paid? If not, why not?” Preserve “Where are the receipts, arrears or tenancy details reflected in your affidavit?” Section 148 of the Bharatiya Sakshya Adhiniyam, 2023 concerns cross-examination on previous written statements. When a writing is intended to contradict a witness, draw attention to the precise parts relied upon before proving it for that contradiction, where this evidentiary regime applies. Check transitional rules for proceedings continuing under earlier law. Family Court evidence caution: Sections 14 and 15 of the Family Courts Act, 1984 provide for evidentiary flexibility and recording a memorandum of the substance of testimony. Make sure the important admission and any qualification are accurately reflected. An annexure is not automatically a proved fact, and electronic records can raise authenticity and applicable Section 63 BSA requirements. If the witness says “I don't remember” Ask whether the witness recognises the account, signature or filed affidavit. Put the specific date and entry. If recollection genuinely fails, shift to reliable documentary proof rather than repetitive accusations. If the witness disputes the document Record the denial and establish identity, source, authenticity and proper proof, or seek appropriate production. Do not describe the disputed record as admitted. If the record is private or sensitive Request proportionate, court-supervised production for defined issues and time periods. Protect the spouse's and children's sensitive information. Never use unauthorized access or harassment as an evidentiary shortcut. 12. A ready-to-use bank of 24 additional questions Select questions based on the live pleadings. There is no value in asking every question simply because it appears in a checklist. Employment and receipts What work, employment or consultancy have you undertaken since separation? What was your actual last-drawn remuneration and when was it paid? Which accounts have received compensation for such work? What is the source of the recurring credits identified at page [X]? Do your ITR and Form 16 figures correspond with the declared income? What material financial change has occurred since you signed the affidavit? Expenses and child support How was the monthly rent figure in paragraph [X] calculated? Is the filed agreement the current agreement for the entire claimed period? Have utilities or society charges been counted separately or twice? Which school fees are annual, quarterly and monthly? Has either parent paid the school or medical provider directly? Are any medical bills recurring or reimbursed by insurance? Assets and business interests What is your ownership percentage in the identified company or partnership? What salary, dividends, drawings or fees have you received from it? Does the company pay any personal accommodation or vehicle expenses? What rental receipts, if any, were generated by the disclosed property? Are deposits, securities or investments subject to restrictions or loans? Have you disclosed all materially relevant interests and financial benefits? Liabilities, earlier orders and corrections Who is the borrower on the claimed loan? Who actually paid its installments during the relevant period? What previous maintenance or monetary-relief orders have been passed? What amounts under those orders were paid, deposited or recovered? Which other dependants are financially supported by you, and how? What corrected or supplementary disclosure, if any, is now required? 13. Three answers — three different next moves Witness's answer What counsel should do Admission: “Yes, I received those credits.” Clarify their nature and period; secure the admission; stop when the proposition is complete. Explanation: “It was reimbursement.” Ask for underlying expense and accounting support; record credible explanations fairly. Denial: “That statement is not mine.” Establish document identity and proof; consider an appropriate records custodian or production application. Witness control is not aggression. A carefully limited question can establish a legally useful fact without inviting a long debate. Where an explanation is necessary, allow it to be recorded accurately. 14. Two sample submissions after the evidence is recorded For the spouse seeking maintenance “The respondent has disclosed only ₹25,000 in monthly income. However, the admitted receipts, identified business benefits and other proven resources require the Court to assess the actual financial position. We ask the Court to account fairly for documented tax, business obligations, genuine dependants, the applicant's reasonable needs and children's separate expenses under the governing statute.” For the spouse contesting the claimed amount “The applicant claims ₹30,000 per month in rent, but the lease and available payment entries reflect a lower basic figure for the earlier period. The Court should first reconcile any subsequent increase, maintenance charges and actual payments. The final award should rest on supported needs, the parties' actual resources and a fair evaluation of the explanation on record.” Do not submit that a single inconsistent line automatically defeats maintenance. Eligibility and quantum remain for the court to determine under the applicable statute. 15. Seven mistakes that weaken your cross-examination Asking unconnected personal questions instead of testing a statutory issue. Calling every bank credit salary without verifying its character. Using business turnover as personal income without reconciliation. Assuming a qualified spouse must be earning despite the distinction in Shailja . Ignoring the period of a lease when testing a current rent amount. Forgetting prior maintenance orders and any actual payments. Failing to preserve an admission or the witness's qualification in the court's record. 16. The final court-day checklist Applicable statute and issues confirmed Court has permitted oral evidence / cross-examination Pleadings and affidavit paragraphs indexed Source and proof status of every document checked Credits differentiated from salary, transfers or loans Business profits and personal benefits separated Rent, bills and periodic expenses reconciled Children's costs separately calculated Genuine liabilities and dependants considered Earlier orders and payment records collected Denial and explanation follow-ups prepared Critical admissions accurately recorded The guiding principle: One clear question tied to an identified affidavit statement, supporting document and legally relevant issue is more useful than ten accusations. Effective cross-examination produces a reliable record, not a performance. Frequently asked questions Can a spouse be cross-examined in a maintenance case? Yes, where oral evidence and cross-examination are part of the proceeding or permitted by the court. It is not automatic at every interim maintenance hearing, which may be decided on affidavits and pleadings. Which documents are most useful in maintenance cross-examination? The pleadings, financial disclosure affidavits, appropriately obtained bank records, ITRs, salary and business records, rent agreements, loan documents, children's bills and prior maintenance orders—depending on the specific dispute. What does Rajnesh v. Neha require? Among other things, Rajnesh v. Neha establishes financial-disclosure directions in maintenance proceedings, subject to the judgment's qualifications, and addresses quantum, prior orders, adjustment and document production with the court's permission. Does a qualified or employable spouse automatically lose maintenance? No. Shailja v. Khobbanna distinguishes earning capacity from actual earnings. Courts evaluate actual income, sufficiency, reasonable needs and the applicable statutory requirements. Can a lawyer treat every bank credit as salary? No. A transaction may represent remuneration, reimbursement, a loan, transfer, business receipt or other payment. Its source, nature, frequency and relevant ownership must be established. What if the same parties have maintenance orders under different laws? Earlier orders and payments should be disclosed. Rajnesh v. Neha requires consideration of adjustment or set-off for overlapping awards. Existing orders are not automatically extinguished by a new proceeding. How do you confront a witness with an earlier written statement? Where the BSA applies, Section 148 requires attention to be drawn to the particular written portions intended for contradiction before proving the writing for that purpose. Check any applicable transitional provisions. Does a missing receipt prove a maintenance expense is false? No. Evidence should be assessed in context. The absence of a receipt does not necessarily show that ordinary household, child-related or medical expenditure was never incurred.
